Terms & Conditions

1. Definitions

  • "Booking Form" refers to the form used for booking or rebooking a Participant for sessions, as outlined on the booking page on the Website.

  • "Carer" refers to the person who accompanies the participant to the session and is responsible for their welfare.

  • "Session(s)" refers to a Riders Ready Bike Club session described on the Booking Form.

  • "Coach" refers to the individual engaged by Riders Ready Bike Club to coach sessions. Whilst every effort will be taken to maintain consistency of Coaches, Riders Ready Bike Club retains the right to change coaching staff where necessary.

  • "Fees" refers to the value chargeable to attend Sessions, as specified on the Booking Form.

  • "Parent" refers to a parent or legal guardian of the Participant who will be responsible for the payment of the Fees and who is the contracting party to this contract and who shall (if the Carer is not the Parent) be responsible for compliance with these Terms & Conditions by the Carer.

  • "Participant" refers to the child who is attending or who is booked onto a Riders Ready Bike Club Session, whose details are specified by the Parent or Carer on the Booking Form.

  • "Premises" refers to the location where the Sessions take place.

  • "Riders Ready Bike Club" refers to the company or person with whom you have entered into this contract in respect of the provision of Sessions.

  • "Term" refers to the agreed-upon dates specified on the Booking Form and as described under "Upcoming Sessions" on the Website.

  • "Terms & Conditions" refers to the terms and conditions set out in this document and any special terms and conditions agreed in writing by Riders Ready Bike Club and the Parent.

  • "Website" means the website at https://www.ridersreadyclub.com/

2. Acceptance

  • All agreements and issues relating to the teaching of the Sessions by Riders Ready Bike Club to the Participant and the ongoing communication with Coaches and staff are subject to these Terms & Conditions to the exclusion of all others.

  • No variation or addition to the Terms & Conditions shall be binding unless agreed in writing by Riders Ready Bike Club and the Parent.

  • These Terms & Conditions shall be deemed accepted by the Parent and the Carer once the box is ticked on the Booking Form and confirmation of payment of Fees has been received by Riders Ready Bike Club.

  • Riders Ready Bike Club reserves the right to cancel this contract at any time before the Participant commences a Term, for any reason whatsoever. Riders Ready Bike Club shall not be responsible for any loss or damage arising from such cancellation, but will refund Fees paid for the remaining Sessions in the Term.

 

3. Confidentiality

  • By agreeing to these Terms & Conditions, the Parent and/or Carer agrees not to share any aspects of Riders Ready Bike Club’s programme with a third party who may be involved in a business that operates in the same market. The Parent and/or Carer will not be involved directly or indirectly with such a company.

  • The Parent and/or Carer will not take, replicate, or use any Riders Ready Bike Club material directly or indirectly for his/her own use or for use by any third party.

  • The Parent and/or Carer agrees not to be directly or indirectly involved in or interested in any business that competes with Riders Ready Bike Club while the Participant is enrolled and for a period of one year thereafter.

 

4. Parent/Carer Obligation

  • The Parent warrants that the information provided on the Booking Form is accurate and up-to-date at the time of booking. Any changes will be sent by the Parent and/or Carer to Riders Ready Bike Club immediately.

  • It is the Parent and/or Carer’s responsibility to inform Riders Ready Bike Club of any special medical conditions at the point of booking. This includes behavioural disorders.

  • The Participant and/or Parent and/or Carer must not attend any Session whilst suffering from any serious illness or contagious disease.

  • During all Sessions, the Parent and/or Carer agrees and accepts sole responsibility, general conduct, and care for the Participant during the Session and whilst on the Premises.

  • Riders Ready Bike Club does not allow parents and/or Caregivers to leave participants for any amount of time before, during, or after a Session.

  • Riders Ready Bike Club shall have the sole right to exclude the Participant and/or Parent and/or Carer either permanently or for such period as it determines necessary for the safety and well-being of other participants, parents, or carers.

5. Outdoor Classes

Where Classes are run in a public space, such as a park, recreation ground, or sports club operated on council grounds, our Coaches will always carry out a dynamic risk assessment, including an inspection of the area being used for Riders Ready Bike Club Classes. If, for any reason, the area is not deemed safe or appropriate, the Session will be moved. This inspection will not encompass the wider area, and Riders Ready Bike Club assumes responsibility only for the area marked out for the Class.
Riders Ready Bike Club will not be held responsible for any incidents that are out of our control. Parents/Carers must assume the same responsibility they would during any visit to a public area, and as a result, take full responsibility for themselves and their dependents. For avoidance of doubt, the behaviour of members of the public, pets, and wildlife is all deemed to be out of the Riders Ready Bike Club’s control.

6. Limitation of Liability

The Parent and/or Carer agrees that any claim made against Riders Ready Bike Club must be made in writing within 30 days of the incident taking place. Failure to report in writing within this time will negate any such claim.
The maximum aggregate liability for Riders Ready Bike Club to the Participant, Parent, and/or Carer will not exceed the Fees.
Neither Riders Ready Bike Club nor any Coach, assistant, employee, agent, or representative accepts responsibility for loss, damage, or expense incurred by a Participant, Parent, and/or Carer arising directly or indirectly in connection with attendance at Sessions, or any act or omission on the part of Riders Ready Bike Club or its representatives.
All warranties and conditions, whether implied by statute or otherwise, are excluded, provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of Riders Ready Bike Club or its representatives, nor affect statutory rights.
The Parent and/or Carer agrees that any product purchased from Riders Ready Bike Club is to be used at their own risk. Riders Ready Bike Club will not accept responsibility for personal injury due to improper use. All equipment should be used under the supervision of a parent or carer.

 

7. Fees & Payment

The Parent shall pay the Fees for the Sessions to Riders Ready Bike Club prior to the Participant commencing a Session.
The Fees are non-refundable in any circumstances, except with the written consent of Riders Ready Bike Club.

 

8. General

By agreeing to these terms and conditions, the Parent consents that the data provided (non-financial) can be shared within Riders Ready Bike Club for operational purposes.
The Parent shall indemnify and keep indemnified Riders Ready Bike Club against all loss (including loss of profit), liability, cost and expenses which Riders Ready Bike Club may incur directly or indirectly as a consequence of any action or inaction of the Parent, Carer and/or Participant.
Any notices to be sent by either party shall be sent by pre-paid recorded delivery or hand-delivered to the address of the relevant party and shall be deemed to have been received within 48 hours of posting or immediately if hand-delivered.
The failure by either party to enforce any one or more of the obligations arising under this contract shall not be a waiver of them or of the right at any time subsequently to enforce them.
These Terms & Conditions constitute the entire agreement between the parties and supersede prior agreements and understandings.
